In a video statement on YouTube, Ahmad Nadim “ApoRed” Ahadi commented on the allegations of his bankruptcy, sweepstakes fraud and rip-off. He indicated that he only filed for bankruptcy to save on taxes. Now lawyer Christian Solmecke commented on the situation after he pointed it out without playing.

What is the current situation?

  • YouTuber MiiMii accused Ahadi of ripping off his viewers and “revealed” that ApoRed was bankrupt.
  • However, ApoRed replied in its own video: He had money and he only activated the “Insi mode”. He filed for bankruptcy in Germany to escape the high taxes.

What did Unge say in his reaction video? When ApoRed explained how he didn’t have to pay high taxes in Germany, he looked around quite confused and could hardly believe what he was hearing:

What does the lawyer say about the situation? Solmecke first looked at bankruptcy notices.de to see exactly what was available at ApoRed. Accordingly, insolvency proceedings have not yet been opened, since it must be checked whether it can be asserted and whether there is enough money for it.

A provisional insolvency administrator was also appointed.

What does an insolvency administrator do? He now determines what Ahadi is allowed to buy and what not. Furthermore, anyone who owes anything to ApoRed must pay the insolvency administrator. He now manages the YouTuber’s money to secure the assets for any upcoming bankruptcy proceedings.

What happens if the insolvency proceedings are actually opened? Then the YouTuber has to cede a large part of his income to the insolvency administrator for 3 years. After these 3 years, ApoRed would be almost completely debt-free if he adhered to the “good behavior phase”.

What does compliance phase mean? Solmecke explained that during the personal bankruptcy Ahadi was obliged to work, had to hand over winnings from the lottery and as a self-employed person he had to give up the amount that he would have earned through appropriate employment.

What does Solmecke say about “Insi mode”? “It stands to reason that ApoRed is making itself artificially poor here in order not to have to pay taxes. But before that he should have, in my opinion, taken a look at Article 283 of the Criminal Code.”

According to Section 283, there is a risk of imprisonment of up to 5 years if, in the event of over-indebtedness or impending/encountered insolvency, parts of your assets are put aside if insolvency proceedings have been opened. Solmecke goes on to say in relation to ApoRed:

(…) And that’s actually critical, because that’s a criminal offense and you can go to jail for 5 years if he has created his fortune or secretly brought it abroad, so to speak. We don’t know that one hundred percent, but the assumption is of course very, very close. And he says: ‘I’ll just build my new existence somewhere else – abroad. And then I’m simply unpunished here.’

What other consequences can there be? According to Solmecke, it may even be that greed is behind Ahadi’s plan, as “unscrupulous and planned as ApoRed’s approach was here”. This is therefore considered a particularly serious offence. Accordingly, the YouTuber faces up to 10 years in prison.

In addition, according to § 370, another 5 years of imprisonment are added if you give the tax authorities false information. “Anyone who creates assets abroad in order not to pay taxes here – yes, dear people, classic case of tax evasion.”

So, can ApoRed count itself poor and escape from debt? No, according to Solmecke, he cannot if Ahadi commits one of the crimes mentioned above and is convicted. Furthermore, there is a risk of a fine and you have to pay your debtors permanently.

“This video, what ApoRed did there, as a reaction to the MiiMii video, was a shot backwards – a shot in the oven,” the lawyer concluded.
