Apple sued for hearing loss caused by its AirPods headphones to a 14-year-old boy

A Texas couple sued Manzana alleging that his 14-year-old son suffered a “permanent hearing loss” in 2020, when his AirPods earphones gave off an alert so loud it tore one of his eardrums.

As detailed in the court filing, accessed by the Reuters agency, the minor was watching Netflix with an iPhone and his AirPods Pro, at a low volume, when “Suddenly and without warning, an Amber Alert came on at a volume that tore his eardrumdamaged his cochlea and caused significant damage to his hearing.”

In addition, they indicated that after the incident the minor suffered dizziness, vertigo and nausea and that you will need to wear a hearing aid for the rest of your life.

In the complaint, they assured that “the AirPos do not have instructions to adjust the alert sound or warnings that the volume could be so high that it would cause damage.” And that Apple was aware that its devices were reproducing extremely high alerts, since there were user complaints about them dating back to 2019.

The Amber Alert is part of a US government emergency notification program, which serves to alert citizens when the police are tracking a missing person in the area, in addition to providing other urgent notices. This notification system is also in force in other countries.
